Mayo Wynne Baxter client obtains clinical negligence claim settlement of £200,000

A Mayo Wynne Baxter client recently agreed a settlement of £200,000 in his clinical negligence claim against a local NHS Trust. Our client, 64, underwent surgery to designed to relieve longstanding back pain. In the days following surgery it emerged that our client had contracted an infection at the site of the surgery. Our client had to return to hospital on numerous occasions for treatment of the infection, which culminated in reversal of the original procedure. Our client contended that the infection resulted from negligent care and that he is now significantly more disabled as a result of the infection.

Although the Defendant admitted that the care provided fell below acceptable standards in various respects it maintained that the infection would have occurred anyway and that the majority of our client’s injuries are attributable to a pre-existing injury in any event.

These issues remained in dispute throughout the course of our client’s claim and proceedings were issued on his behalf. Following exchange of expert evidence and a settlement meeting with the Defendant’s representatives a pre-trial compromise of £200,000 plus costs was agreed.
